These terms govern your use of trainedstate.com, an informational website operated by STACSTRAT LLC. By using the site you accept them. They do not govern the Trained State product itself, which is provided to customers under a separate written agreement.
What this site is
The site describes Trained State, a security awareness training program and record system, some of which is in pilot and some of which is planned. Descriptions of modules, packs, features and timelines are our current intentions and may change. Nothing on the site is an offer capable of acceptance; any engagement is made only under a signed agreement.
Regulatory information is general, not advice
The site refers to regulations and standards, including 21 CFR Part 11, HIPAA, the FTC Safeguards Rule, PCI DSS and others. We check those references against the primary sources and say so, but they are summaries offered as general information. They are not legal, regulatory or compliance advice, and you should not rely on them as such. Trained State is designed to support an organization's obligations under those frameworks. It does not make an organization compliant on its own; compliance depends on your procedures, your validation and how you use any system, and only you and your advisers can make that determination.
Ownership
The site's text, design, layout and the Trained State name and mark belong to STACSTRAT LLC. You may read, link to and quote briefly from the site with attribution. You may not copy substantial parts of it, present it as your own, or use the name and mark in a way that suggests endorsement or affiliation without our written permission. Third-party names and marks mentioned on the site, including those of regulators, standards bodies and other vendors, belong to their owners; mentioning them does not imply endorsement in either direction.
Acceptable use
Use the site as a website. Do not attempt to probe, disrupt or gain unauthorized access to it or the systems behind it, overload it, or use automated tools against it beyond what a reasonable search engine or archive does. If you believe you have found a security weakness, tell us through the address in our security.txt and give us a reasonable chance to fix it before disclosing it.
Links to other sites
The site links to third-party resources such as eCFR, Cloudflare and Google. Those sites have their own terms and privacy practices, which we do not control and are not responsible for.
Privacy
What the site collects, which is very little, is described in the privacy notice and cookie statement.
No warranty
The site is provided as it is and as available. To the fullest extent the law allows, STACSTRAT LLC disclaims all warranties about the site and its content, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We try to keep the site accurate and available, but we do not promise that it will be free of errors, interruptions or harmful components.
Limitation of liability
To the fullest extent the law allows, STACSTRAT LLC and its members, officers and staff will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, data, business or goodwill, arising from your use of or inability to use the site, however caused. Where liability cannot be excluded, it is limited to the greatest extent permitted. Some jurisdictions do not allow some of these exclusions, so some may not apply to you.
Changes
We may change these terms by posting a new version here with a new effective date. Continued use of the site after that date means you accept the change.
